1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and UltasDev ("Company", "we", "our", "us") regarding your use of the HeightMax mobile application ("App", "Service").

By downloading, installing, or using HeightMax, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Important: Please read these Terms carefully. They include important information about your legal rights, remedies, and obligations.

2. Description of Service

HeightMax is a personal wellness and growth tracking application that provides:

  • Height tracking and growth monitoring tools
  • AI-powered coaching and personalized guidance
  • Training and exercise programs
  • Educational content related to health and wellness
  • Progress tracking and analytics
  • Notification and reminder features

The Service is provided "as is" and may be modified, updated, or discontinued at our discretion.

3. Eligibility

To use HeightMax, you must:

  • Be at least 13 years old. If you are between the ages of 9 and 13, you may only use the App with the supervision and explicit consent of a parent or legal guardian.
  • Have the capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

For users under 18: Parental or legal guardian consent is required to use the App. Parents and guardians are responsible for monitoring and supervising the Service use by minors.

4. License and Restrictions

4.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use HeightMax on your personal mobile device for personal, non-commercial purposes.

4.2 Restrictions

You agree NOT to:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or attempt to extract the source code
  • Remove, alter, or obscure any copyright notices
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the functionality of the App

5. Subscriptions and Payment

5.1 Free and Premium Features

HeightMax offers both free and premium features. Premium features require a paid subscription, which may be offered on a weekly, monthly, or yearly basis.

5.2 Payment Processing

All payments are processed through:

  • Apple App Store for iOS users
  • Google Play Store for Android users

By purchasing a subscription, you agree to the payment terms of the respective app store.

5.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Cancellation

You can cancel your subscription at any time in your App Store or Play Store account settings. The cancellation will take effect at the end of the current billing period.

5.5 Refunds

Refund requests are subject to the refund policies of the Apple App Store or Google Play Store. We do not process refunds directly. Please contact the respective app store for refund requests.

You acknowledge and agree that:

  • The AI coaching feature provides general wellness guidance, not medical advice.
  • Always consult with a qualified healthcare professional before making health-related decisions.
  • Results vary and are not guaranteed.
  • Height growth is influenced by genetics, nutrition, hormones, and other factors beyond the App's control.
  • You assume all risks associated with using the training programs.
  • Stop use and seek medical attention if you experience pain, discomfort, or adverse effects.

By using HeightMax, you release us from any and all liability related to health outcomes, injuries, or adverse effects.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULTASDEV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
